Terms and Conditions

General Provisions

Please read these terms of use ("Terms and Conditions") carefully. By accessing or using the Dermomart website, mobile application, or other services, you agree to comply with these Terms and Conditions. These Terms govern your use of the Services and constitute a legal contract between you and Dermomart.

• All agreements are governed by the laws of Rwanda.
• The terms include the conditions for concluding and terminating sales agreements, as well as data security measures.

Definitions

• Order Form: Electronic form required to place an order on www.dermomart.com.
• Customer: Any user entering into a sales agreement with Dermomart.
• Product: Items sold on www.dermomart.com.
• Shop: Dermomart's online store.

Product and Order Information

• 1. Dermomart conducts wholesale and retail sales of Products via the Internet.
• 2. Products offered through the Shop are brand new, free from physical or legal defects and have been legally introduced onto the Rwandan market.
• 3. The information provided at www.dermomart.com does not constitute an offer as defined by applicable law. By placing an Order, the Customer makes an offer to buy a selected Product under the terms set forth in the Product description.
• 4. The Product prices at www.dermomart.com are given in Rwandan Francs (Rwf), US Dollars ($), and include all measurable costs, such as value added tax (VAT).
• 5. The Product prices at www.dermomart.com only become binding when the Customer has placed an Order. This price is unaffected by any price changes once the Order has been placed.
• 6. Orders can be placed through the website 24 hours a day, 365 days a year by completing an Order Form at www.dermomart.com.
• 7. The Customer is required to register an Account to place an Order.
• 8. Customers are required to read and accept these Terms and Conditions during Order placement.
• 9. Orders are processed between: 9:00 a.m. and 6:00 p.m., on Working Days. Orders placed after 6:00 p.m. on Working Days as well as Orders placed on Sunday or a public holiday shall be processed the next Working Day.
• 10. Special priced Products (promoted as part of a sale) are only available in limited numbers. Orders for special priced Products will be processed in the order in which they are received, until the Products are sold out.

Concluding Sales Agreements

• In order to conclude a Sales Agreement, the Customer must place an Order, in accordance with the rules set forth under 3 points 6 and 8, by the method made available by the Seller.
• After placing a purchase Order, the Customer immediately receives an Order confirmation from the Seller.
• Receiving an Order confirmation from the Seller is the point at which the Order becomes binding on the Customer. The Order confirmation and acceptance is sent to the Customer via email.
• The Order confirmation email shall include the following elements:
  • Confirmation of all relevant Order details
  • Model statement of withdrawal from the agreement
  • These Terms and Conditions containing information on the right of withdrawal
• After receiving the confirmation email, as set forth under point 4, the Sales Agreement between the Customer and the Seller is finally concluded.
• Each Sales Agreement shall be confirmed by a proof of purchase (an invoice) attached to the Product.

Methods of Payment

• The following payment options are made available to the Customer:
  • Online payment via online payment systems (Master Card, VISA, Momo)
• All electronic payments must be made before an Order can be processed. Available electronic payment systems include payments by credit card as well as instant bank transfers in selected Rwandan banks.
• The Customer shall pay the amount equal to the purchase price specified in the Sales Agreement within 2 working days from the date of its conclusion unless indicated otherwise in the Sales Agreement.
• Product shall be dispatched only after payment is received.

Delivery

• Subject to stock availability with suppliers and receipt of payment, requests will be processed within two (2) working days and handed over to a courier company for delivery. Order processing can be subject to stock delays. Delivery is free for orders in excess of $200 within Rwanda, and a flat courier fee applies to orders below $200.
• We deliver to houses, farms, military bases, major chain stores, power stations, and lodges. We do not deliver to vacant land or plots.
• We will supply all goods to the delivery company in good order and will strive to ensure that goods arrive at your chosen delivery address in the same good order.
• Delivery times vary:
  • Customers in Kigali can expect deliveries within 1-2 business days.
  • Customers in the rest of Rwanda can expect deliveries within 3-5 business days.
• All international orders (for delivery outside of the Republic of Rwanda), once dispatched from our premises, are non-returnable and non-refundable due to their permanent export status once the parcel leaves the borders of Rwanda.
• Returning a consignment would attract a return shipping fee and applicable import duties and taxes, which would be for the purchaser’s account.
• The purchaser is responsible for instructing if insurance should be taken out on the consignment. Dermomart will send replacements for significant product damages resulting in loss of product during transit only if insurance was taken out. Dermomart will not be liable for replacements if product damages occur without insurance.
• All international shipping, processing, and handling charges are for the purchaser’s account, including any import duties and taxes exercised by the country of import. Dermomart will not be liable for transport costs or applicable taxes and will not provide indicative quotes for import duties due to their varying nature from territory to territory.
• The purchaser is responsible for ensuring all relevant waybill delivery details are correct, including names, delivery addresses, and other relevant contact information required for the import of goods into their country.
• Dermomart will not be held liable for charges or fees involved in amending incomplete, invalid, or incorrect information supplied for the shipping waybill after a consignment has been shipped.
• Our export pricing is the same as our website display pricing.

Returns or Refund Policy

• Subject to LAW Nº 31/2017 OF 25/07/2017 ESTABLISHING RWANDA INSPECTORATE, COMPETITION AND CONSUMER PROTECTION AUTHORITY AND DETERMINING ITS MISSION, ORGANISATION AND FUNCTIONING, if you have received a product from us and found that the container (either plastic or glass) is defective or leaking, or if the pump or nozzle mechanism is defective, please contact our Customer Care Line at +250 790005000 within ten (10) working days of delivery. We will gladly collect the product at our own expense and provide you with a refund, replacement, or store credit.
• Upon delivery, if you no longer want the product you have ordered, you may return it to our physical address within 10 days of the order date, at your own expense. If the product is unopened and the original packaging is still intact, we will provide you with a Dermomart credit. We do not provide monetary refunds in these circumstances. The above clauses are subject to the following guidelines:
• Products must have been purchased directly from us. We cannot accept returns of products purchased from other retail outlets. Please return those to the store where purchased.
• Products must be returned within 10 days of the order date.
• Please include a copy of your receipt (or a note with your order number, name, email address, and phone number) and your reason for returning the product(s).
• We cannot accept returns or issue refunds on used products.
• Original shipping and handling charges are non-refundable (if applicable).
• Products specified as non-returnable or not for resale cannot be returned.

Manage Your Account

Through your account "MY ACCOUNTS," you are able to access, edit, or delete information you've provided to us, including:

• Name and password
• User ID
• Email address
• Physical address
• Phone number
• Gender
• Payment method or payment services provider
• User profile information, including images and videos you have uploaded to the Services

User Data

Dermomart collects and processes your personal data when you visit our website or mobile applications to provide and continually improve our products and services. The data is used to:

• Process orders
• Deliver products and services
• Process payments and communicate with you about your orders, products, services, and promotional offers
• Keep and update our database and your accounts with us
• Propose a targeted navigation experience
• Prevent and detect fraud and abuse on our website

Data Security

• We have put in place appropriate security measures to prevent your personal data from being accidentally lost, used, or accessed in an unauthorized way, altered, or disclosed.
• We limit access to your personal data to employees who process your personal data on our instructions, and they are subject to a duty of confidentiality.
• We have set procedures to deal with any suspected personal data breach and will notify you and any applicable regulator of a breach where we are legally required to do so.

Your Legal Rights

• It is important that the personal data we hold about you is accurate and current. Please keep us informed if your personal data changes during your relationship with us.
• If you would like us to stop processing or storing your personal information for any reason, please write to us at support@dermomart.com, allowing us 14 (fourteen) working days to complete your request. You may also write to us to request what personal information we currently hold about you.

Type and Scope of Electronic Services

• The Service Provider grants access to the following Electronic Services:
  • Concluding Product Sales Agreements
  • Newsletter
• These Terms and Conditions shall apply to all Electronic Services provided through www.dermomart.com.
• The Service Provider reserves the right to display advertising content at www.dermomart.com. Advertisements are an integral part of the online Shop front and the materials presented therein.

Conditions of Providing Services and Concluding Electronic Services Agreements

• The Electronic Services set forth under § 12 of these Terms and Conditions are free of charge.
• Term of the agreement:
  • Electronic Services Agreements enabling the User to place an Order are concluded for a definite period of time and terminate upon placement or withdrawal of the Order.
  • Electronic Services Agreements for the provision of the Newsletter are concluded for an indefinite period of time.
• End-user hardware, network, and software requirements for the ICT system used by the Service Provider:
  • A computer (or a mobile device) with an active Internet connection
  • Access to an email account
  • An Internet browser
  • Enabling cookies and JavaScript in the Internet browser
• The User agrees to use the Shop in accordance with the principles of good practice, only for lawful purposes, and in a manner that does not infringe the personal rights and intellectual property rights of any third party.
• The User is obliged to provide accurate and complete information to the Service Provider.
• The User is prohibited from providing any unlawful or illegal content.

Intellectual Property

• The compilation of all content at www.dermomart.com, as well as materials used under a license, assignment of copyrights, or fair use, is protected by copyright law and is the exclusive property of Dermomart. The User shall bear all liability for damages caused to the Service Provider by any unauthorized use of the content of the website located at www.dermomart.com without the consent of the Service Provider.
• Any use or reproduction of the content of the website located at www.dermomart.com, or any portion thereof, without the express written consent of the Service Provider constitutes a copyright infringement and is punishable under civil and criminal law.

Final Provisions

• Agreements concluded through the Shop are construed in accordance with the laws of Rwanda.
• Should any provision of these Terms and Conditions be prohibited by applicable law, the provisions of Rwandan law shall apply in lieu of the unenforceable provision.
• Any disputes between the Shop and Consumers arising out of or in connection with a Sales Agreement shall be resolved in the first instance through amicable negotiation between the parties with the intention of amicable settlement of the dispute in accordance with the Act on out-of-court consumer dispute resolution. Should such resort prove of no avail or unsatisfactory to any of the parties, disputes shall be resolved in a court of competent jurisdiction under point 4 of this section.
• Consumer Customers may use Alternative Dispute Resolution schemes after the internal complaints procedure is finalized, such as submitting a request for mediation or a request for arbitration to competent arbitrators.
